Indemnification

Nature of Testing: I understand that the dynamometer used by TuneSmith is designed to simulate high loads on the engine and drivetrain components of motor vehicles for calibration purposes. This testing process may subject my vehicle to intense mechanical stress.

Assumption of Risk: I am aware that the use of the dynamometer involves inherent risks, including but not limited to increased wear and tear on engine and drivetrain components, and the potential for mechanical failures. I voluntarily assume all such risks associated with the testing process.

No Liability for Wear and Tear or Mechanical Failures: I acknowledge that TuneSmith takes all reasonable care in performing dynamometer testing; however, TuneSmith, its employees, agents, and representatives shall not be held liable for any wear and tear, mechanical failures, or damages that may occur to my vehicle as a result of the testing.

Vehicle Condition: I confirm that my vehicle is in good mechanical condition, and I have disclosed any known issues or concerns to TuneSmith prior to the dynamometer testing.

Release of Liability: In consideration of the services provided by TuneSmith, I hereby release and discharge TuneSmith, its employees, agents, and representatives from any and all claims, liabilities, demands, actions, causes of action, costs, and expenses arising out of or in connection with the dynamometer testing.

Indemnification: I agree to indemnify and hold harmless TuneSmith from any claims or liabilities, including legal fees, arising out of my use of the dynamometer services.

I have read this waiver and release form carefully and fully understand its contents. I am agreeing to it voluntarily and with full knowledge of its significance.
